MERIT-BASED HIRING AND PROMOTION
MERIT-BASED ACADEMIC ADMISSION

  1. MERIT-BASED HIRING AND ACADEMIC ADMISSION IS THE LAW: The United States
    Constitution, the Civil Rights Act of 1964, and the Equal Pay Act of 1963 prohibits discrimination
    based on race, color, religion, sex, or national origin.

    • Employment determination (hiring, firing, promotion) or a determination of admission to
      college or a magnet secondary school cannot discriminate based race, color, religion, sex,
      or national origin.
    • Equality of opportunity that produces diversity of outcomes with no pre-determined quotas is encouraged. Inequality of outcome based on favoritism given to certain race, color,
      religion, or national origin over others is illegal.
  2. “DIVERSITY, EQUITY, INCLUSION” (DEI) PRACTICES FAVOR UNEQUAL OUTCOME
    FAVORING CERTAIN DEMOGRAPHIC GROUPS OVER OTHERS

    • DEI-based preferences use demographic data (such as race, color, religion, sex, or national origin) to influence decision-making at all levels, including determination of employment (hiring, firing, promotion) and academic admission.
    • DEI erects artificial barriers between demographic groups, where one group is favored
      over another based on their race, color, religion, sex, or national origin. According to DEI
      practices, decision-making based on “merit” alone is inherently unjust since certain groups
      are handicapped by systemic racism or bigotry and require special dispensation to succeed.
    • “Diversity” refers to “marginalized groups” that have been subject to historical
      discrimination such as blacks, non-white Hispanic, native American, and the LGBTQ.
      Caucasians and Asians (includes Hindu Americans) are considered “dominant” due to their
      visibility in positions of power. “Equity” focuses on fairness and justice for members of
      the marginalized group. “Inclusion” is about making members of the marginalized group
      feel like they belong, their perspective is heard, and they are valued in any setting.
    • Marginalized group members qualify for preference (i.e. an invisible set aside quota) in employment (hiring and promotion) and in academic admission regardless of their
      qualifications. Marginalized group members are given preference in curriculum
      development, training, research grants, government funding, organizational policies and
      practices, and organizational culture.
  3. DEI-BASED PREFERENCES DISCRIMINATE AGAINST HINDU AMERICANS
    • In DEI preferences for marginalized groups, performance metrices such as academic
      excellence, hard work, and volunteerism for the social good are devalued in importance.
    • The dominance of Hindu Americans is visible in elite academia, in preeminent professions such as law, medicine, investment banking. Their presence is also noticeable at the highest levels in corporate America, in politics and in government. Hindu Americans are thus
      qualified as a “dominant” and a “privileged” class because of their success. DEI practices
      are artificial barriers to thwart Hindu American success based on merit.
  4. AMERICAN HINDU COALITION FIGHTS FOR THE RIGHTS OF HINDU AMERICAN
    YOUTH.

    • IN THE COURTS:
      -Students for Fair Admission vs. Harvard – won judgement against Harvard for discriminatory DEI practices against Asian American students (include Hindu Americans).
      -Parents Coalition for TJ vs. Fairfax County School Board (Virginia) – Court recognized
      DEI discriminatory practices against Asian American students (include Hindu Americans)
      in admission policy for Thomas Jefferson High School of Science & Technology (TJ).
      -Pending – litigation to ban DEI practice in employment (hiring, firing, promotion)
    • IN STATE GOVERNOR’S OFFICE: Virginia Governor Glenn Youngkin: Education
      reform to ban DEI practices in magnate school admission.
    • 2024 POLITICAL CAMPAIGNS: Ban DEI in academic admission and in employment
      -Trump Campaign
      -US Senate/Congress Campaign: GA, PA, VA, NJ
